Mediation Basics

Mediation allows you and your spouse to sit down with a neutral third party, preferably an attorney neutral, to examine and discuss the different divorce-related issues you are facing and arrive at solutions that benefit the family. It enables you to maintain control of the outcome of your case rather than having a judge make decisions for your family.

In Mediation, neither party has an attorney, but instead relies on a neutral legal professional who provides confidentiality and neutrality throughout the process. As your mediator, my responsibilities would be to:

  • Facilitate communication between both parties
  • Complete all paperwork properly and on time
  • Ensure both parties understand their rights and the law
  • Ensure both parties make knowing and voluntary decisions
  • Provide creative ideas on ways to solve issues

If you are considering using a Mediator, it is important that you meet together with the Mediator so that neither Party believes that the Mediator has taken sides with one or the other. Therefore, when you call for an initial consultation, do not provide too many details before selecting an attorney neutral. I can discuss the process to help you decide if Mediation is the right alternative for you, while preserving confidentiality and neutrality.
